ABDULLAH MOHAMMED AL RUZIQI SPC ("Company," "we," "us," or "our"), is committed to providing high-quality products and services to our customers. This Warranty and Liability Policy ("Policy") outlines the terms and conditions under which we provide warranties, the extent of our liability, and the provisions related to force majeure events.
1.Limited Warranty
We provide a limited warranty on our products to ensure customer satisfaction and to protect against defects in materials and workmanship. This limited warranty is valid for a period of 9 months from the date of purchase (the "Warranty Period"). During the Warranty Period, if a product is found to be defective due to materials or workmanship, we will, at our discretion, repair or replace the product at no additional charge to the customer.
This warranty covers only the original purchaser of the product and is non-transferable. Proof of purchase, such as a receipt or invoice, is required to validate any warranty claim. The warranty does not cover damage resulting from misuse, unauthorized modifications, improper installation, normal wear and tear, or accidents. Additionally, the warranty does not apply to consumable parts, such as batteries, unless the defect is due to a manufacturing fault.
2.Warranty Claims
To initiate a warranty claim, please contact our customer service team at Admin@ruzaiqi-machinery.com or +968 76955110 within the Warranty Period. You will be required to provide proof of purchase and a description of the defect. If the warranty claim is approved, we will provide instructions on how to return the defective product. We reserve the right to inspect the product to determine the validity of the warranty claim.
If the product is deemed to be defective and covered under the warranty, we will, at our discretion, repair or replace the product. If the product is no longer available or cannot be repaired, we may offer a similar product or issue a refund at our discretion. All replaced or refunded products become the property of the Company.
3.Limitation of Liability
Our liability under this Policy is limited to the repair or replacement of defective products as specified in the Limited Warranty section above. Under no circumstances shall ABDULLAH MOHAMMED AL RUZIQI SPC be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of use, arising out of or related to the use of our products or services, even if we have been advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability under this Policy shall not exceed the original purchase price of the product. This limitation of liability applies to any claims based on contract, tort, or any other legal theory.
4.Exclusions from Warranty
This warranty does not cover:
- Products that have been altered, modified, or repaired by anyone other than the Company or its authorized representatives.
- Products that have been subjected to misuse, abuse, neglect, or improper installation.
- Damage caused by accidents, natural disasters, or external factors beyond our control.
- Normal wear and tear, including cosmetic damage such as scratches, dents, or fading.
- Consumable parts, such as batteries, unless they are found to be defective due to a manufacturing fault.
5.Force Majeure
The Company shall not be liable for any delay or failure to perform its obligations under this Policy if such delay or failure results from circumstances beyond our reasonable control ("Force Majeure Event"). Force Majeure Events include, but are not limited to, acts of God, war, terrorism, civil unrest, strikes, labor disputes, natural disasters, pandemics, government actions, embargoes, or other events of a similar nature.
In the event of a Force Majeure Event, our obligations under this Policy shall be suspended for the duration of the event. We will make reasonable efforts to mitigate the effects of the Force Majeure Event and resume performance as soon as possible. If the Force Majeure Event continues for an extended period, either party may terminate the contract without liability, provided that the other party is notified in writing.
6.Governing Law and Jurisdiction
This Warranty and Liability Policy and any disputes arising out of or related to it shall be governed by and construed in accordance with the laws of Oman, without regard to its conflict of law principles. Any legal action or proceeding arising out of or related to this Policy shall be brought exclusively in the courts of Oman, and you hereby consent to the jurisdiction of such courts.
7.Policy Modifications
We reserve the right to modify or update this Warranty and Liability Policy at any time without prior notice. Any changes will be effective immediately upon posting on our Website. Your continued use of our products and services following the posting of changes constitutes your acceptance of those changes. We encourage you to review this Policy periodically to stay informed about our warranty and liability practices.
